The FCC has dismissed Levine/Schwab Partnership’s Petition For Reconsideration for the dismissal of their application for a new translator on 105.5 in San Fernando CA. The group originally filed for their translator in May 2018 to rebroadcast their CP for 1500 KWIF Culver City. Estrella Media’s 105.5 KBUE Long Beach filed a Petition To Deny noting listeners who would experience interference from the signal despite the fact that KBUE simulcasts on 94.3 KBUA San Fernando. Levine/Schwab then amended their application to operate with lower power, which KBUE again found listeners who would experience interference. They then filed a second amendment to drop to 1 watt with the Petition For Reconsideration, however the FCC finds it as procedurally defective. They state that there is “no provision in the Rules for an applicant to file multiple petitions for reconsideration or multiple attempts to correct defective applications” and their “longstanding policy concerning defective applications, applicants are afforded one opportunity to correct defective applications and seek nunc pro tunc reinstatement”.
