FCC Report 5/21: New Erie Allocation Dismissed

[membership level="2,3"] Rick Rambaldo's ERIE Radio Company winning application for a new FM on 100.9 in Westfield NY serving Erie PA has been dismissed as the company failed to make its down payment in time and has been denied a waiver. ERIE Radio Company's $714,000 bid in FCC Auction 98 was the highest of any bid in the auction as the company outbid Connoisseur Media and Westfield Broadcasting for the the allocation. ERIE was required to submit $107,100 to the FCC by August 26, 2015, but due to what it claimed was circumstances beyond its control the payment did not reach the agency until 4:35pm on the 27th with a one sentence letter from its bank claiming that it was responsible for the error. The company also submitted its full payment six days early to try to prove to the FCC it was financially capable of meeting its obligations. The agency declined all of its arguments and assessed a default payment on the company for $107,100 or 20% of its net bid. ERIE Radio Company had announced its intentions in January to acquired the intellectual property of Classic Hits 88.5 WMCE Erie to place on 100.9 once Connoisseur Media Rock “ Rocket 101 ” WRKT North East buill out its CP to relocate to 104.9 and the new 100.9 facility was built. ERIE Radio Company also owns CHR " Happi 92.7 " WEHP Lawrence Park in the Erie market. The FCC has also rejected Nelson Quintanilla's Petition For Reconsideration against a $25,000 fine for operating a pirate station in Panorama City CA. Quintanilla did not contest to operating the station, but stated he had limited income and another person, no longer in the United States, was the owner of the transmission equipment. Rubena Hemmings was issued a Notice of Unlicensed Operation for running a pirate on 102.5 in Bronx NY. Dismissals The Raftt Corporation's 2014 application to increase 1520 KQQB Stockdale TX from 2.5kW day to 20kW day/23kW critical hours was dismissed as the critical hours pattern overlaps with the protected contour of Claro Communications' 1540 KEDA San Antonio. Deletions This week's recipient of a Red Light Delinquency letter and station deletion is Del Rosario Talpa's Regional Mexican 1310 KFVR Crescent City CA. Educational Media Foundation's CP for 94.5 K233CW Green Valley AZ was deleted as its CP expired unbuilt. FM Changes CSSI Non-Profit Educational Broadcasting Corporation's 89.5 KYQX Weatherford TX amends its application to increase power from 100w to 340w/158m . With its CP to move from 103.7 to 104.5 set to expire next week, Cochise Broadcasting's KXZK Vail AZ applies to drop to 299w/14m . AM Changes Catholic Radio Network's 1090 KEXS Excelsior Springs/Kansas City MO applies to increase daytime power from 8kW to 10kW, while retaining its 4kW critical hours power.
