FCC Report 1/8: Operating From Former Site Leads To KYTE’s Cancellation

102.7 KYTE Independence NewportThe FCC has dismissed the license renewal and cancelled the license of Yaquina Bay Communications’ 102.7 KYTE Independence OR deeming the license expired as the station did not operate from its licensed facilities for over three years.

Following KYTE’s license renewal application in September 2021, the licensees of 100.7 KPPT-FM Depoe Bay and 102.7 KIEV-LP Camas WA filed objections stating that KYTE was operating from an unauthorized transmitter site that did not provide coverage of Independence and was causing interference to their stations. KYTE had completed a move from Newport OR to Independence in September 2017, but filed an STA in May 2018 stating it was unable to operate from the new site on Bald Mountain “until generator is sent and returned from manufacturer for warranty replacement”. The STA sought to return to its former site on Otter Crest Mountain, which was granted until December 1, 2018. The objectors included spectrum analyzer readings noting that KYTE had continued to operate from Otter Crest beyond the expiration of the STA, which no renewal was ever filed. In a response to a letter of inquiry sent by the FCC, KYTE stated, “due to budget constraints the State of Oregon did not provide power to the site, forcing Licensee to purchase two generators with which to operate its transmitter. However, Licensee mistakenly purchased generators designed as backup and not primary generators, one of which failed and was returned to the manufacturer. The manufacturer advised Licensee that the generator was not designed for primary use, and further advised that it had failed due to the use of bad propane fuel. Licensee’s efforts to rectify the situation with the generator manufacturer, the propane supplier, and its insurer were unsuccessful. Because of the pandemic, Licensee was unable to afford to purchase a new generator, and it further lost its lease to the Bald Mountain Site.” The station claims it has been unable to find another site to provide coverage to Independence and asked for a short-term license renewal so it could find a buyer to reestablish service from Bald Mountain.

As the station’s license was deemed expired for operating with unauthorized facilities for more than 12 months, the FCC has deemed the license of KYTE expired and cancelled.

Martin Broadcasting has surrendered 1050 KRMY Killeen TX and its translator 94.1 K231DF.

FCC Actions

Due to technical issues affecting their Online Public Inspection File system, the FCC has extended the deadline for all documents due since January 1 to be filed by January 31.

Top O’Texas Educational Broadcasting Foundation, Inc has been requested to amend its application to move 92.3 KIJN-FM Farwell TX to Umbarger to provide additional evidence in support of the proposed modification. The FCC says the move would not result in a preferential arrangement of allotments and requests that Top O’ Texas submit additional information as to the overall public interest benefits that would be advanced by the grant of its proposal.

The FCC has issued a citation to Broadcast Supply Worldwide for unlawfully marketing a transmitter that was capable of operating outside of the FM frequency band, did not use a permanently attached antenna or an antenna that uses a unique connector, lacked an equipment authorization, and lacked the appropriate labeling and user manual disclosure and three additional devices that lacked the appropriate labeling and user manual disclosures. If BSW were to continue marketing Rolls HR70 FM Broadcast Transmitter (HR70), the Decade MS-100, MS-100M, and MS-100S it would be liable for significant fines of up to $22,021 per day for each unauthorized model marketed.

The FCC entered into a Consent Decree with Bird Street Media Project’s 91.1 KROV Oroville CA for failing to maintain its online public file.

Silent Notifications

High Plains Radio Networks took multiple stations silent at the end of 2022 telling the FCC that their tower leases are expiring on February 28 and are looking to find a new affordable site lease or renegotiate with their current site owners. The stations that went silent are: 96.5 KKNM Bovina TX, 98.3 KICA-FM Farwell TX, 980 KICA Clovis NM, 1090 KVOP Plainview TX, 1400 KREW Plainview TX, and 1590 KDAV Lubbock TX.

  • 2B Productions’ 1410 WEGO Salisbury NC (sale of translator/explore other options)
  • Chesapeake-Portsmouth Broadcasting’s 1010 WHKT Portsmouth VA (returned loaned equipment)

AM Changes

After being ordered to drop daytime power from 50kW to 35kW

The STA sought to return to its former site on Otter Crest Mountain, which was granted until December 1, 2018. The objectors included spectrum analyzer readings noting that KYTE had continued to operate from Otter Crest beyond the expiration of the STA, which no renewal was ever filed. In a response to a letter of inquiry sent by the FCC, KYTE stated, “due to budget constraints the State of Oregon did not provide power to the site, forcing Licensee to purchase two generators with which to operate its transmitter. However, Licensee mistakenly purchased generators designed as backup and not primary generators, one of which failed and was returned to the manufacturer.
