FCC Report 8/7: FCC Selects 27 Tentative Non-Comm MX’d Filings

FCC Seal 2020 Federal Communications CommissionThe FCC has chosen tentative selectees for 27 groups of mutually exclusive applications from the 2021 non-commercial filing window.

  • Free Radio Santa Nella’s 90.9 Santa Nella CA was chosen over Ondas de Vida’s application for Volta on the tie-breaker that it has no interest in any other station.
  • Stonewall Alliance of Chico’s application for 90.9 Willows CA was chosen over two other groups
  • Weimar Institute’s 91.9 Grass Valley CA is selected over three other applicants
  • InVerse Focus Ministry’s 88.5 Rochelle GA wins over Association for Community Education for not having any attributable radio interests
  • Elijah Radio’s 90.7 Live Oak FL beats out six other applicants on the attributable interest tie-breaker
  • Lumpkin Educational Broadcasting’s 90.3 Dahlonega GA wins over Community Public Radio’s Cleveland GA application on points
  • Living Springs Retreat’s 91.5 Bowdon GA beats out two other groups as the only established local applicant
  • Restored Together Radio’s 91.3 Bowman GA wins over two other applicants on the points for having the best technical proposal
  • Elijah Radio’s 91.9 Milledgeville GA beats World Federation of Pastors and Ministers of the Full Gospel as best technical proposal because it proposes to serve at least 25% more area and population
  • Urban Community Life’s 91.3 Summerville GA defeats three other groups on points
  • Society Of Saint Vincent De Paul Holy Spirit Conference’s 88.3 Rockford ID beats out seven other applications as an established local applicant and best technical proposal
  • Poderosa Broadcasting’s 88.3 North Chicago IL beats out Relevant Radio on points for diversity of ownership
  • Optima Enrichment’s 91.5 Delafield WI outlasts three other groups on the final tiebreaker as it was able to demonstrate that can that it applied in a previous filing window and had its application accepted for filing and but dismissed in favor of an applicant possessing superior points or a tie-breaker, was in as a legal entity at
    all times from the date of the previous NCE filing window until the present, and does not hold any current non-commercial license or permit
  • Vanguard Association of Sunbelt Colleges Corporation’s 90.5 Middletown IN wins over six other applicants in a tie-breaker for having no other licenses
  • Holy Family Communications’ 91.5 Strasburg VA wins over two other groups on points
  • Evangelistic Knights of Our Lady’s 88.1 Escanaba MI wins out over Full Potential on points
  • West Central Michigan Media Ministries’s 88.9 Houghton MI defeats Gospel Opportunities as the best technical proposal because it proposes to serve at least 25% more area and population
  • Cornerstone Community Radio beats three other groups for its 89.1 Iron Mountain MI as the best technical proposal criterion because its proposal would serve at least 25% more area and population than the next best
  • Community Broadcasting’s 88.3 Sedalia MO bests two other applicants on points
  • Gospel Broadcasting’s 90.9 Mount Airy NC beats two other groups as an established local applicant
  • Down East Communications and Center for the Performing Arts’ 88.3 Jacksonville NC wins out over three other groups for having the least amount of pending applications
  • Marfa Public Radio’s 90.1 Fort Stockton TX outlasts two other groups for having less existing licenses.
  • City of Hobbs, New Mexico’s 89.3 Hobbs NM defeats seven other applicants on points
  • St. Lawrence University’s dueling applications for 88.9 Saranac Lake and 89.3 Tupper Lake NY defeat four other groups, but since both are owned by the same applicant the tie-breaker is moot. The FCC directs them to submit a voluntary time-share agreement within 90 days.
  • Texas Public Radio’s 91.9 Gonzales TX outlasts two other applicants on a tie-breaker for having the fewest existing authorizations
  • Brazos TV’s 88.1 Hooks TX beats six other groups as the best technical proposal criterion because it proposes to serve at least 10% more area and population than the next best
  • University of Utah’s 91.3 Duchesne UT defeats seven other applications on points

FCC Actions

The FCC has levied a $25,000 fine against the Estate of Steven Silberberg and his thirteen license holding companies for failing to timely file applications for involuntary transfer of control following the passing of Silberberg in January 2021 with his son Jacob Silberberg taking over the controlling shares of the companies. The filings are required to be made within 30 days, but were not made until October 2021. The company also failed to timely file applications for STA’s to take 1420 WRSA St. Albans VT and 107.7 W299AM Lebanon NH silent. WRSA and W299AM went off the air in February 2021 before resuming operations in December 2021, but did not apply for an STA until September 2021.

Ink People’s 89.7 KIPE Pine Hills CA and Fitchburg State University’s 91.3 WXPL Fitchburg MA have entered into consent decrees for failing to maintain their online public files.

  • Gulf-California Broadcast Company’s Regional Mexican 1400 KESQ Indio CA (tower being decommissioned)
  • 25-7 Media’s News/Talk 920 KLMR Lamar CO (water damage from storm)
  • Western Slope Communications’ Sports “ESPN 690” KRGS Rifle CO (transmitter failure)
  • Panhandle Community Radio’s Variety 88.5 KRFY Ponderay ID (loss of transmitter site lease)
  • Blue Sky Broadcasting’s News/Talk 1400 KSPT Sandpoint ID (loss of transmitter site lease)
  • West Windsor-Plainsboro Regional School District’s Variety 107.9 WWPH Princeton Junction NJ (HVAC and transmitter issues)
