Educational Communications of Colorado Springs is seeking reconsideration of the FCC’s rejection of their waiver to allow Audacy’s 99.5 KQMT-HD3 Denver to feed their 90.7 K213EG Littleton CO.
ECCS applied in early June for the waiver as part of its upgrade from from 3 watts on 90.5 to 250w on 90.7 to carry their “The Light” Christian programming based at 90.5 KTLF-FM Colorado Springs on via KQMT-HD3 on the grounds that because the programming on the HD3 would be completely noncommercial it would preserve and be consistent with the intent of the rule and would have accepted a condition upon grant of the license for K214FV requiring that it only broadcast noncommercial programming.
The FCC denied the request with a brief response, “Regardless of the programming on KQMT-FM HD3, the authorization can not list KQMT-FM as K213EG primary station since KQMT-FM is a commercial station. We have denied this request in the past and we are in agreement that this will not change.”
ECCS is arguing that the denial does not discuss the reason why the waiver should not be granted stating that the Administrative Procedure Act of 1933 requires a reasoned analysis as to why the waiver should not be granted, which was not provided.
KQMT-HD3 currently serves as the parent signal for ECCS’ 106.3 K292FM Denver, which is legal since the translator is in the commercial band.

iHeartMedia has turned in the license of 93.3 K227DS St. Louis. The 25w/159m translator had rebroadcast Gospel “Hallelujah 1600” KATZ St. Louis since signing on in 2021.
