The FCC has deleted the license of Synergy Media North Dakota’s 97.9 KLTQ Beulah ND after a Petition To Deny from Digital Syndicate Network got the licensee to admit it did not return the station to operations when it previously filed a resumption of operations with the FCC from its Silent STA on the day the license would have expired.
After its 2016 sale to DSN failed to close, Synergy took KLTQ silent on 8/15/2018 due to “financial concerns”. The Resumption of Operations notice was filed on 8/15/2019 but after DSN noted that the station had not begun operating, Synergy stated that their lawyer filed it unaware that it had been delayed an additional day with an amendment seeking a waiver request due to tower crew shortages and weather delays. DSN claimed it wasn’t until August 18 that it began operating.
The FCC came down hard on Synergy claiming that the “unavailability of tower crews” and “unusual amount of rain which made the tower site inaccessible for installation of the equipment” was due to poor planning as the station was taken off the air for financial and not technical reasons stating that “Synergy made a business decision to take the Station off the air, and chose not to take steps to return the Station to the air until after it had entered into an agreement to sell the Station. Then, it decided not to secure the services of a tower crew until it signed a lease for a new tower site. Synergy’s choices resulted in an extremely tight timeline that did not allow for even minor difficulties hiring a tower crew, let alone minor weather-related delays. The situation Synergy finds itself in is one of its own making.”
With the decision, the $20,000 sale of KLTQ to William Glass was also dismissed.
Conundrum Communications Investments Inc.’s 94.1 KWDI Idalia CO was deleted after being silent for over 365 days.
Dismissals
Centro Cristiano de Vida Eterna’s application to relocate 96.9 K245DE Boerne TX to 96.7 and closer to San Antonio was dismissed after KDRY Radio Inc. filed an Informal Objection stating that their 1100 KDRY Alamo Heights did not grant them written authority and does not grant its consent to rebroadcast their station as claimed in the application.
