Sandhyabahen Modi’s Max Frequency LLC has defaulted on its three construction permits it won in FCC Auction 109 in 2021. Max Frequency was the winning bidder of 95.3 Teague, 97.3 Bogata, and 102.7 Milano TX, but requested dismissal of the applications in August.
Under FCC rules, Max Frequency is still liable for a deficiency payment of 20% of its total $141,050 winning bids for the three allocations or $28,210. Once those three allocations are re-offered in a subsequent FCC auction, they will be responsible for the difference between their gross defaulted bid and the subsequent gross winning bid, whichever is less.
The FCC is seeking comments on a proposed rulemaking by engineer Charles Anderson to allow exceptions, under certain circumstances, to the FM spacing requirements when attempting to relocate a station from aging towers or lost tower sites to existing towers. Anderson says the new proposed subsection “would allow deviation from the spacing limitations set forth in subsection (e), provided a showing is made that no greater interference will be caused to short-spaced stations than would occur at the minimum distances specified in subsection (e).”
